The opportunity to make a challenge during canvassing is required by COMAR 33.08.01.08. The challenge must be made at the time the ballot or provisional ballot application is presented for acceptance or rejection. The right to challenge a ballot or provisional ballot application is waived if it is not made at this time.
How can an observer make a challenge?
Verbally through Google Meet or using the chat feature on Google Meet. This must be done before the Board moves on to another ballot.
The challenger then has one (1) hour to submit the Canvass Challenge Form. This can be done by emailing washco.elections@maryland.gov. The completed form can be submitted via email or text; a picture of the completed challenge form is acceptable. Once received, the local board shall decide the challenge. If the challenger does not provide the completed form within one (1) hour, the local board shall proceed as if there was no challenge to the ballot or provisional ballot application.
